P. Angelides & Co LLC Successfully Represents Ikids Group Before EUIPO in Trade Mark Opposition

Nicosia, Cyprus — P. Angelides & Co LLC has successfully represented iKids Group Spółka z Ograniczoną Odpowiedzialnością, a Warsaw-based company, in opposition proceedings before the European Union Intellectual Property Office (EUIPO), resulting in the complete rejection of an opposition filed against the company’s European Union trade mark application.

The case was handled by Theodoros Angelides, Partner and Head of Intellectual Property Matters at P. Angelides & Co LLC, acting as professional representative for the applicant before the EUIPO.

In its decision dated 3 March 2026, the EUIPO Opposition Division rejected Opposition No. B 3 224 135, which had been filed by the French company IDKIDS against Ikids Group’s figurative EU trade mark application covering goods in Class 28 and services in Class 41.

The opposition was based on a French word mark “ÏDKIDS”, with the opponent alleging a likelihood of confusion under Article 8(1)(b) of the EU Trade Mark Regulation (EUTMR).

After assessing the similarities between the marks, the goods and services concerned, and the relevant consumer perception, the EUIPO found that no likelihood of confusion existed between the earlier mark and the contested sign.

Although certain goods were considered similar to the opponent’s retail services relating to toys, games and sports equipment, the EUIPO determined that the overall similarity between the marks was limited. The decision noted that the element “kids” is descriptive for products aimed at children and therefore has low distinctiveness, meaning that similarities based on this element alone could not create confusion among consumers.

The Office further found that the remaining elements of the marks created distinct overall impressions, particularly due to the different wording and the figurative features of the contested sign. As a result, the Opposition Division concluded that consumers would clearly distinguish between the two marks, even when taking into account the imperfect recollection typically associated with trademarks.

Consequently, the EUIPO rejected the opposition in its entirety and ordered the opponent to bear the costs of the proceedings.

The decision represents an important outcome for Ikids Group, enabling the company to proceed with the registration of its European Union trade mark and to continue expanding its brand presence within the European market for toys, games and entertainment-related services.
